Terms of Use

These terms govern your use of the XREMS EMS Remote Android application, provided by SROMLINE GmbH, Vorderi Böde 1, 5452 Oberrohrdorf, Switzerland ("we", "us"). By installing and using the app, you accept them.

The app is provided free of charge. It is a control application for EMS training equipment; the equipment itself is subject to its own terms of sale and warranty.

The app connects to compatible EagleFit EMS devices over Bluetooth Low Energy and allows you to control training modes, channel intensity and program parameters, and to record your sessions locally.

Supported device types: Home EMS, Pants, Pro EMS, Vest, EMS Belt, EMS Belt 2.0.

You agree to:

• read and follow the safety briefing shown when the app first starts,
• read and follow the Medical and Safety Disclaimer,
• use the app only with compatible, undamaged EagleFit equipment,
• not use the app if any contraindication listed in the Medical and Safety Disclaimer applies to you,
• keep your Remote Control room codes confidential,
• not attempt to reverse engineer, decompile or modify the app, except to the extent such restriction is prohibited by mandatory law,
• not use the app to control equipment worn by another person without that person's informed consent.

We recommend keeping the physical device controls within reach at all times so you can stop the session yourself regardless of the app.

We do not guarantee uninterrupted availability. The Remote Control feature depends on our signalling server and on third-party network infrastructure and may be unavailable temporarily or permanently. Core training functionality over Bluetooth does not depend on an internet connection.

We are liable without limitation for damage caused intentionally or by gross negligence, and for damage arising from injury to life, body or health caused by our negligence. Any exclusion of liability for unlawful intent or gross negligence is void under Art. 100(1) of the Swiss Code of Obligations.

In cases of ordinary negligence we are liable only for breach of a material contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and only for foreseeable damage typical for this type of contract.

Liability under the Swiss Product Liability Act (PrHG) and, where applicable, under mandatory product liability law of your country of residence remains unaffected.

The app and its content are protected by copyright. Installing the app grants you a non-exclusive, non-transferable right to use it on devices you control, for the duration of your use.

You may stop using the app at any time by uninstalling it. We may discontinue the app or individual features with reasonable notice.

These terms are governed by Swiss substantive law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings at the courts of your place of residence.

For all other users, the exclusive place of jurisdiction is Baden, Canton of Aargau, Switzerland.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Please contact us at contact@xrems.fit first — most issues are resolved directly.
